The Data Controller is VAILLANT SAUNIER DUVAL, S.A.U., with C.I.F. number A-48037295 and registered office at P.I. In order to guarantee the proper management of your data process, VSD has appointed a Data Protection Delegate, whom you can contact for any inquiry at the email address dpo@vaillant-group.com.

The personal data provided by the User may be processed by VSD for any of the purposes detailed below, depending on the type of data provided, the basis of legitimacy and the interactions that the User makes through the APP:

1. Initial registration on the APP:

a. Purpose of the treatment: The use of the services of the App is conditioned to the initial registration of the User in the App together with the acceptance of the Terms and Conditions of Use of the App and the Privacy Policy.

b. Data processed: Identification data.

c. Basis of legitimation: Execution of the established contractual relationship.

2. Management of the user account, provision of the requested services and management of the functionalities of the APP:

a. Purpose of the treatment: VSD may process the User's personal data included in the User Account, in order to be able to offer the Services related to the Installation. In particular, and depending on whether the installation is remotely manageable or not, User data may be processed to:

i. Show the report of the consumption data of the Installation.

ii. Show the current status of the main parameters or schedules applied to your equipment and allow remote action on them,

iii. Provide information on the fundamental data related to the general condition of the Installation, the reference of the maintenance contract including User data, the description of the equipment including the maintenance reports and the history of maintenance and repair activities.

iv. Manage appointments with the Technical Assistance Service for the maintenance or reparation of the Installation,

v. Perform interactions with the Technical Assistance Service.

vi. Manage notifications related to the APP, such as consumption reports or notifications from the Technical Assistance Service.

vii. Manage additional installations related to the user's account.

viii. Manage climate notifications.

b. Data processed: Identification data, contact data and data generated, and approved by the user for a service provision, during the use of the tool.

c. Basis of legitimation: Execution of the established contractual relationship.

3. Geolocation:

a. Purpose of the treatment: the APP will ask the User for permission to share their location, through the geopositioning systems of their mobile device, to send the user notices based on the user's location, such as consumption when he/she is not at home or installation notices based on the setpoint temperature.

b. Data processed: User location data.

c. Basis of legitimation: Consent of the User. The User may deactivate any of these functionalities at any time from his/her mobile.

4. Satisfaction surveys:

a. Purpose: To carry out possible satisfaction surveys after the provision of the Technical Assistance Service.

b. Data processed: Identification data.

c. Basis of legitimation: legitimate interest of VSD about the quality of the provides services in order to improve them continuously. The user can request additional information about VSD legitimate interest is valued by contacting us through es.dpo@vaillant-group.com.

5. Own commercial communications:

a. Purpose of the treatment: VSD may send own commercial communications to Users, in order to promote the use of the App and share content related to the Services of the App, marketing actions or promotions.

b. Data processed: Contact data and Identification data.

c. Basis of legitimacy: VSD legitimate interest on arousing User interest and promoting products and services contracting, as well as, on improving VSD image. The User can request additional information about how VSD legitimate interest is valued by contacting us through es.dpo@vaillant-group.com.

6. Third party commercial communications:

a. Purpose of the treatment: VSD may send commercial communications from third parties to Users, in order to promote their products and services, share their offers and other marketing actions, provided that the user has authorized it.

b. Data processed: Contact data and Identification data.

c. Basis of legitimation: Consent of the User

7. Commercial communications from other companies into Vaillant Group:

a. Purpose of the treatment: VSD may send commercial communications from other companies into Vaillant Group to Users, in order to promote their products and services, share their offers and other marketing actions, provided that the user has authorized it.

b. Data processed: Contact data and Identification data.

c. Basis of legitimation: Consent of the Use.

8. Internal profiling:

a. Purpose of treatment: VSD may send personalized commercial communications customised for the interested parties’ needs, preferences and personal circumstances. VSD may collect information about the use of products and services, as well as analyse the characteristics or the patterns resulting from the analysis of such data, in order to adapt marketing offers and activities to each User, offering personalized products and services.

b. Data processed: Socioeconomic data, Employment data, other categories of data related to the use of the products and services offered.

c. Basis of legitimation: Legitimate interest of VSD for improving the commercial offer, directing customers to products and services adapted to their personal characteristics and preferences. The User can request additional information about how we have assessed our legitimate interest and your own interests by contacting us at es.dpo@vaillant-group.com.

9. External source profiling:

a. Purpose of treatment: VSD may send personalized commercial communications adapted to interested users’ needs, preferences, and personal circumstances. VSD may process data of interested parties and create profiles with data from external sources to adapt the offers and marketing activities to Users, offering personalized products and services.

b. Data processed: Socioeconomic data, Employment data, other categories of data.

c. Basis of legitimacy: User Consent.

It is reported that, if the User includes in the APP any information and / or personal data of a third party, he/she guarantees VSD that he/she has obtained all the informed authorizations of each interested party, exonerating VSD and Vaillant Group from any responsibility for possible damages of any nature that may arise from this.

VSD may obtain your personal data from the following sources:

• Personal data supplied by Users when registering in and while using the APP,

• Personal data obtained because of the use of the APP and the services provided,

• Personal data communicated by other entities of the Group and necessary for the provision of the requested services, and where appropriate, for verifying User registration in the APP.

To provide the APP Services with the highest quality, VSD needs to share the User's personal data with certain companies of Vaillant Group or other collaborating companies controlled through agreements with Vaillant Group, for a correct provision of services, such as the corresponding Official Technical Assistance Service (www.serviciotecnicooficial.saunierduval.es/localice-su-sat) of the Saunier Duval brand with which the User can contact to maintain a contractual or pre-contractual relationship.

Likewise, following User express request and, for specific services or functionalities in the APP, VSD may send your data to third-party companies for eventual contracting according to User’s request and needs.

VSD ensures that different service providers acting under its responsibility and, on behalf of VSD as data processors, are compliant with current regulations on data protection. The User can find out more about our data processors by contacting VSD at dpo@vaillant-group.com.

The personal data processed because of the use of the APP will be kept for the duration of the legal relationship between VSD and the User (For example, until the request to delete the account, the cancellation of the maintenance service or the withdrawal of consent). Subsequently, the data will be kept, duly blocked, during the limitation period of any responsibilities required of VSD. After this period, User data will be deleted. The User can request more information about the retention periods by contacting VSD at es.dpo@vaillant-group.com.

When the User has given their express consent to send commercial communications from third parties and commercial communications from other entities of the Vaillant Group, the data will be kept as long as they do not object to this use or purpose (withdrawal of consent) and, in any case, duly blocked, for the time necessary to comply with the legal obligations that apply at all times.

VSD respects the current legislation on the protection of personal data, the privacy of the User and the secrecy and security of personal data, adopting the necessary technical and organizational measures to prevent the loss, misuse, alteration, unauthorized access, and theft of the personal data provided, taking into account the state of technology, the nature of the data and the risks to which they are exposed.

Users have the right to access their personal data and to obtain confirmation on how VSD is treating them, as well as to request the rectification of inaccurate data or, where appropriate, to request the deletion of the data when, among other reasons, they are no longer necessary for the processing purposes for which they were collected.

In certain circumstances, the User may request the limitation of the processing of the data, in which case VSD will only keep the data for the exercise or defence of claims.

The User may also oppose to the process of the data according to reasons related to their situation, in which case VSD will stop processing such personal data, except for imperative and legitimate reasons, or for the exercise or defence of claims.

The User may request the right to data portability and obtain for himself/herself, or for another service provider, certain information derived from the relationship formalized with VSD.

Where appropriate, the User also has the right not to be subject to a decision based solely on automated data processing, including profiling, which produces legal effects that concern the User or that significantly affect the User in a similar way.

Finally, the User may revoke his consent at any time, in the event that the consent has been granted for a specific purpose, without affecting the legality of the data process based on the User's consent before the withdrawal of consent.

Likewise, VSD reminds the User that he/she can oppose, at any time, the processing of his/her personal data for commercial or promotional purposes.

Likewise, the User may raise a claim to the Spanish Agency for Data Protection (http://www.aepd.es), especially when the User has not obtained satisfaction in the exercise of their rights.
